Terms And Conditions
The Terms and Conditions specified below represent the terms and conditions under which customers of JC Food Traders Limited (“the Company”) will accept orders made through its website (website contact):
1. The Terms and Conditions below, constitute a contract between the ‘User’ (Hereafter also referred to as ‘The Customer)’ and the Company.
2. The Customer on the placing of any order may either accept or decline the terms below but it is compulsory to accept the said terms if the Customer wishes to use the websites services offered by the Company. By clicking “I Accept” the Customer will be deemed to have chosen to accept these conditions unreservedly.
3. The Company reserves the right to update and amend these terms and conditions on its website without notice to any Customer and any acceptance by the Customer of any amendment shall have the same consequences as stipulated in paragraph 2 above.
Returns/Refund
4. In the event that a product does not fit the description of the good that was ordered by the Customer, the Company will more than happy to try its best to accommodate the Customer’s request but the Company’s firm position is that it cannot accept any offer for the return of goods or give refunds on produce, meats, frozen goods and baby supplies. Any goods eligible for return must be when presented to the Company be unopened with its packaging intact.
5. In the event that a return is requested the Customer will have 3 business days from the date the order is received to request a credit for the returned goods. Requests can be processed via email at returns@johncheameatmart.com or in-store PROVIDED THAT in any case the Company is satisfied with the Customer’s means of identity .
6. The Company cannot offer any cash or credit refunds for any of our orders. Orders that are refunded can only be issued store credit.
Cancellations
7. When an order is placed, it is Final, cancellations cannot be made but can be returned upon being received. For the purpose of these conditions an order is deemed to have been placed when it is submitted and paid for on line.
8. In the event that there is a dispute between the Company and the Customer with respect to the Order the Company will attempt to contact the Customer via email or telephone and in the event there is any disagreement with respect thereto or the order cannot be fulfilled, it will be immediately canceled without any exceptions.
9. If the Company is unable to verify the identity of a Customer or the Customer is using an unsecured site or if the Customer’s site is compromised, the Company reserves the right to cancel the Order.
Shipping/Delivery:
10. The Customer’s order will be delivered to the address indicated in the order placed with the Company and the Customer agrees that the carriage of any goods shipped to the Customer shall be in compliance with the terms and conditions herein.
11. Goods ordered by Customers to be shipped to the Family Islands will be arranged by the Company as per instruction of the Customer in the placement of his order and all additional costs incurred such as freight and any other associated costs will be for the account of the Customer.
12. Upon delivery of the order to the any third party who is not connected with the Company, that person must provide an accurate and correct identification (such as a valid driver’s license) to the Company or its agent before the goods are released and in the event the goods are to be released to a freight forwarder, the Customer must authorize release via email and such authorization shall be deemed to be final and the Customer shall be estopped from denying that such authorization was given.
13. The Company shall not liable for any loss or damage to the goods while the same are not in actual custody and control of the Company and it will not accept any liability for non-delivery due to incomplete or incorrect details being provided when the order was placed. For the purposes of these terms and conditions the Customer shall be deemed to have received the goods when either the Customer himself or the Customer’s duly authorized agent signs and acknowledges the receipt of the same.
14. Orders will be shipped in the order they are received. Delivery will be attempted and fulfilled within 48-hours after the delivery has been placed PROVIDED THAT there is no event of force majeure or act of God which prevented such delivery from taking place.
Pricing:
15. The prices indicated on the website of the Company are shown in Bahamian Dollars (B$) and do not include Value-added-tax and the Company reserves the right to modify the prices at any time but such modification will be communicated to the Customer prior to the placing an order.
16. In the event there is an error in the pricing of the goods comprised in the order, the Company reserves the right to cancel the order and refund the payment made in respect of the goods even if an order has been placed.
